Clinical Negligence

"Bevan Brittan's reputation in the field of clinical negligence is without doubt in the ascendant. Drawing praise from adversaries, as well as clients, medical professionals and the Bar, the practice is well deserving of its reputation for being 'tough', 'practical', 'frank' and 'truthful." Legal 500 2007

“Absolutely superb. . .“very straightforward to deal with and they understand the nature of the work and the difficulties that court deadlines can impose”  Chambers UK, A Client’s Guide to the Legal Profession 2007

Our claims specialists work across the private and public sectors. As well as providing claims resolution advice to a range of insurance companies and self-insured corporations, we also act for numerous public sector bodies, particularly within the NHS.

Our fundamental aim is to ensure that the right claims are settled at the right time and at the right cost. The corollary of this is that unmeritorious claims are identified and fought.

Our experience, personnel and case management systems enable us to handle claims proactively and efficiently, providing innovative solutions in complex and high value cases.

Our lawyers are encouraged to set the agenda for claims resolution, rather than reacting to opponents - particularly by using ADR, which, where necessary, will include formal mediations.

Over the last three years we have dealt with hundreds of claims, ranging from minor injuries to multi-million pound cases. We are frequently involved in ground-breaking reported cases – most recently Thompstone v Tameside in which the High Court decided to link the indexation of future care payments to an earnings-related index rather than the Retail Prices Index. The effect of the decision could be to add over £1.5bn to the NHS budget; we are acting for the Trust in appealing to the Court of Appeal.
