What I do
I head the Projects, Property, Planning and Construction Practice Group at Bevan Brittan. I specialise in construction and civil engineering risk management and dispute resolution involving negotiation, ADR (including mediation and conciliation), adjudication, arbitration and litigation. I have particular experience of post award risk management in PFI and PPP projects - both pre and post Commissioning and including Facilities Management issues. I am a CEDR accredited mediator and I present seminars and workshops on a wide range of dispute related topics.
Some examples
On a major PFI, I have acted for a project company in defending claims for time from its construction contractor and claims for payment from its FM Contractor.
I have been involved in an ICE conciliation and arbitration for a main contractor on extensions of time and loss and expense claims arising from the failure of marine piling.
I have advised an employer on design development, construction, commissioning and early hand-over issues on a pathfinder PFI including drafting a variation to the Project Agreement.
On behalf of an employer, I successfully defended a loss and expense claim in arbitration based on working to a shorter programme than provided for under the contract.
I successfully defended an adjudication for a developer against a claim for disruption and lack of access to site.
For a sub-contractor, I carried out a successful recovery in adjudication on the form of a contract and the subsequent entitlement under that contract.
I acted for three Claimants against 19 Defendants in a complex design issue and bonds litigation which was successfully resolved by mediation.
