My Background
I trained and worked with Wragge & Co LLP for 11 years before joining Bevan Brittan LLP as a partner in September 2007.
What I do
I advise on all types of commercial disputes ranging from multi million pound contractual and negligence claims for major corporates to acting for local authorities.
I have a particular interest in product liability, professional negligence and handling insurance related disputes both for and against insurers including advising on policy wording and other aspects of insurance law.
I also regularly advise on a wide range of health & safety matters including handling prosecutions and advising on workplace fatalities.
Some examples
- Acting for a major UK brewer in a
multi-million pound professional negligence claim over
advice and consultancy services provided by a firm
instructed to design and implement a new supply chain
strategy for their UK business.
- Acting for an IT consultancy
company in a dispute with insurers over policy coverage
following a substantial theft of computer
hardware/software from their premises. The dispute led to
a 6 day trial and involved complex allegations of
material non-disclosure and a claim that fraudulent
invoices were used in order to exaggerate the claim.
- Acting for the Professional
Indemnity Insurers of an Independent Financial Advisor
in a company’s £1.8m claim for alleged negligent advice
not to wind up a Final Salary Scheme.
- Acting for an international
producer and supplier of materials, products and
services principally in the construction industry in a
US$1.7m dispute with its insurers following a major kiln
failure in Jamaica. The dispute centred around the
applicability of a number of policy exclusions and
particularly whether the damage was as a result of
defective design or latent defect and/or operational
error by the employees working in the kiln. The dispute
was dealt with by way of an ad-hoc arbitration.
- Acting on behalf of insurers and
their insured in relation to alleged defective polythene
wrap, which caused deterioration of a company’s pet food
products, resulting in a claim for substantial losses.
- Advised a UK subsidiary of a
major US corporation on a product recall and coverage
under their product liability insurance following the
detection of faulty plugs and battery chargers used in
medical appliances.
- Advised a plant hire company
following a fatal accident to an employee in South
Wales, attending interviews under caution, representing
and giving pleas in mitigation and advising on
subsequent plea in the Crown Court.
