What I do
I
handle and supervise a variety of complex clinical
negligence claims for Defendant Trusts and Strategic Health
Authorities. I try to approach these cases in a spirit of
pragmatic co-operation, resolving issues through discussion
where possible but arguing those that require Court
adjudication. My team and
I aim to
provide practical and innovative advice in order to guide
Defendants through the legal challenges posed by the claims.
Some examples
I represented the Defendant
in YM v Gloucestershire Hospitals which resolved the basis
upon which Foundation Trusts could be regarded as
‘reasonably secure’ for the purposes of the Damages Act
1996, enabling them to make periodical payments.
I have been at the forefront of the NHS response to the challenges made by Claimants to the basis of indexation of periodical payments, which it is estimated could cost the NHS over £2billion. To date, I have successfully defended two cases and am handling the appeal processes on the leading case of Thompstone v Tameside and Glossop.
In the field of Healthcare Associated Infection, I have successfully defended a number of claims arising out of Hepatitis C cross infection from a surgeon to patients, co-ordinating a response over a number of disparate Trusts.
I was instrumental in
devising and implementing an
innovative indemnity agreement which preserved a severely
injured Claimant’s entitlement to a PCT-funded
care package whilst preventing the
simultaneous recovery of a privately funded care
package which would have doubled
the cost to the NHS.
