Complicated infrastructure agreement
We acted for a large affordable housing provider in
connection with the acquisition of a development
site comprising a disused sports ground and a listed
historic train building. This involved entering in
to a complicated infrastructure agreement with
English Partnerships, together with a number of
operational licences with Network Rail and the
British Waterways Board to enable the redevelopment
of the site to take place in close proximity to the
national rail network and a working canal that
adjoined the site.
In addition, the sale agreement incorporated a
number of restrictions, overage provisions and an
option for our client to purchase an adjoining area
of land from the vendor. We were required to secure
necessary rights of way and access both to enable
the intended development to take place, and also to
take into account the possibility of further
development or intensification of use in the future.
Once we had acquired the site and ensured that it
would be handed across with vacant possession, we
continued to advise the client in connection with
ongoing building contracts. These included a site
remediation contract, and construction contracts for
both newbuild and extensive refurbishment works to
be carried out to the existing buildings, including
all associated consultant appointments and security
documentation.
We are in the process of finalising the necessary
detailed planning permission to enable our client’s
development to proceed, and carrying out the
negotiations with the local authority regarding the
relevant planning conditions and Section 106
agreement.
Once completed this development will be comprised of
some 300 residential units, of which 90 will be for
social housing, together with complementary retail
properties and a substantial area of public open
space.
