Central government body - large scale staff transfers.
Following on from our advice in support in the successful restructure of a central government body, we were asked to advise on the employment aspects of two large scale staff transfers.
This project involved setting up a policy framework for dealing with the staff transfers, identifying the staff within the functions transferring, consideration of roles/duties, detailed procedures for assimilating and/or redeploying staff, one-to-one interviews to establish preferences, and significant consultation with staff/representatives.
We supported the body during this process in the following ways:
• advising on the Transfer of Undertakings (Protection of Employment) Regulations and the Statutory Transfer Order
• reviewing the Policy Framework for staff transfer documentation,
• advice on scoping the staff assigned to the transfer to the two organisations,
• drafting documentation,
• advice on consultation with the Partnership Forum (which included staff representatives and staff side/union reps from the constituent organisations affected and members of the HR Advisory Group)
• and advice on negotiations with the new providers in relation to, for example avoiding redundancies.
Finally, we provided support in relation to consequential effects for the body of the functions transfer.
The body’s aim in this project was for staff to feel positive about transferring to the new organisations. They sought to do this by establishing a fair, objective and transparent process which offered equal treatment for all staff potentially included in the Transfer Order. We worked with the Commission to achieve that; balancing a legal assessment, risk, staff preference where possible and a practical approach to the process.
